Debate Lab: Should Government Have Lawful Access to Encrypted Devices?
The Garden State Cyber curriculum culminates this unit with a structured debate:
Government should have lawful access to any encrypted message or device.
This is a policy debate, not a technical exploitation exercise.
Use only the teacher-provided case materials and approved sources from Lesson 2.
Prepare both sides first
Before teams receive or choose a position, every student must complete:
Access-side claim
Write the strongest evidence-backed reason supporting lawful access.
Security/privacy-side claim
Write the strongest evidence-backed reason opposing a required access mechanism.
Shared factual ground
List three facts both sides should be able to accept based on the assigned materials.
Uncertainty
List one important point the source packet does not resolve.
Build a claim-evidence-reasoning card
For every argument:
Claim
What are you asserting?
Evidence
Which assigned source supports it?
Reasoning
How does the evidence support the claim?
Limitation
What does the evidence not establish?
Rebuttal risk
What is the strongest challenge the other side could make?
Debate architecture, not slogans
Weak:
Privacy is a right, so no access ever.
Weak:
If you have nothing to hide, access should not matter.
Stronger arguments specify:
- scope of access
- legal process
- technical implementation
- security consequences
- oversight
- abuse resistance
- alternatives
- effects on different stakeholders
Debate format
Opening statement
Two minutes per side.
State the policy position and two strongest arguments.
Technical cross-examination
Each side asks one architecture question.
Examples:
- How would authorization be technically limited?
- What prevents reuse or unauthorized access?
- What happens when a required access mechanism is compromised?
- What alternative investigative methods are available in the provided case materials?
Policy cross-examination
Each side asks one governance question.
Examples:
- What legal threshold should be required?
- Who provides oversight?
- How should misuse be detected?
- Who bears risk if the policy fails?
Rebuttal
Respond to the strongest version of the opponent's case, not a weaker substitute.
Closing statement
State what trade-off your position accepts.
A position that claims zero cost is probably incomplete.
Observer scorecard
Students not speaking in a round score:
- factual accuracy
- source use
- technical reasoning
- fair representation of opposition
- response to trade-offs
- clarity about uncertainty
Do not score based on which position the observer personally prefers.
Post-debate position memo
After hearing both sides, write a short individual memo.
You may support, oppose, or qualify the proposition.
Your memo must include:
- final position
- strongest evidence supporting it
- strongest opposing argument
- one technical risk
- one policy benefit or cost
- one safeguard or limitation you would require
- one unresolved question
Changing your mind after the debate is allowed. That is evidence of learning, not inconsistency.

Finish with:

Cybersecurity decisions often sit where engineering, law, risk, and values meet. The professional skill is being able to explain the trade-off without pretending the trade-off disappears.
